1. Acceptance of Terms and Services
These Terms and Conditions ("Terms") govern your use of the car wash services, facilities, website, and membership plans operated by Orca Splash Car Wash ("we," "us," "our") at 22730 Parkway Lakes Ln, Richmond, TX 77407, and all our associated locations, and your use of orcasplash.com. By purchasing a wash (at our locations, on our website, or through a third-party marketplace such as Way.com), entering the wash facility, or enrolling in a plan, you agree to these Terms.
We offer single washes, wash packages, add-on services, and recurring membership plans. Availability, hours, equipment, and wash features may vary and may change without notice (e.g., maintenance, severe weather, or equipment faults). We may refuse service to any vehicle we reasonably believe is unsafe to wash, oversized, or unsuitable for our equipment.
2. Purchases via Way.com, Pricing and Payments
- Washes and plans for this location may be purchased through our listing on Way.com (way.com/carwashdetails/15938391/orca-splash-car-wash/). Purchases made on Way.com are processed by Way.com and are also subject to Way.com's own terms of use and privacy policy; redemption of those purchases at our location is governed by these Terms.
- To redeem a Way.com purchase, present the voucher/QR code or confirm your enrolled license plate as instructed on site. Vouchers are valid only at this location unless stated otherwise.
- Prices are as posted at the location, on our website, or on the Way.com listing at the time of purchase and may change without notice. Posted prices exclude applicable taxes unless stated otherwise.
- At the point of sale, we accept cash, credit and debit cards, and contactless payments as available.
- For memberships, you authorize recurring charges to your stored payment method (via Way.com for plans purchased there) until you cancel. Declined charges may be retried; wash privileges may be suspended until payment succeeds, and plans may be canceled after repeated failures.
- Washes used during a period later subject to a chargeback or reversal may be billed at the standard single-wash rate, and membership privileges may be suspended pending resolution.
- Gift cards and prepaid balances have no cash value and are not redeemable for cash except where required by law.
3. Memberships and Unlimited Wash Plans
- Unlimited plans cover one enrolled vehicle per plan, identified by its license plate, and are not transferable between vehicles, households, or persons without our approval.
- "Unlimited" is subject to fair use: typically, one wash per vehicle per day. Commercial use (e.g., rideshare fleets or resale of washes) on a personal plan is prohibited unless agreed in writing.
- To change your enrolled vehicle or plate, notify us at the location or at (832) 776-0344 or [email protected]; for plans purchased on Way.com, update your vehicle in your Way.com account. You remain responsible for charges until the change is processed.
- Cancel at any time with at least 7 days' notice before your next billing date — at the location, via the original payment method, or through your Way.com account for plans purchased there. Cancellation stops future billing; the current period remains usable through its end date and is not refunded.
- We may change plan pricing or benefits with at least 30 days' notice; continued use after the effective date constitutes acceptance.
- Plate sharing, plate swapping, or other misuse may result in immediate termination without refund.
4. Vehicle Condition, Damage Claims and Limitation of Liability
Before entering the wash, you must close all windows, doors, sunroofs, and convertible tops; retract or remove antennas; fold in mirrors where instructed; and secure or remove loose exterior items (racks, magnets, flags, loose trim, aftermarket accessories). Keep hands, arms, and pets inside the vehicle and follow all posted instructions and staff directions. Vehicles older than 15 years or with known paint, trim, glass, or seal defects are washed at the owner's risk.
- Damage claims must be reported to on-site management before leaving the premises, or within 24 hours with supporting evidence. We may review camera footage, equipment logs, and vehicle condition before accepting any claim.
- We are not responsible for damage arising from pre-existing conditions, items left in or on the vehicle, antennas, wipers, mirrors, racks, or aftermarket accessories, or vehicles outside posted size limits.
- To the maximum extent permitted by law, our total liability for any claim is limited to the cost of repair of verified wash-caused damage or, for service issues, the amount paid for the wash in question. We are not liable for indirect, incidental, or consequential damages.
- Nothing in these Terms limits liability that cannot be excluded under applicable law, including for gross negligence or willful misconduct.
5. Refunds and Rewash, Privacy and LPR, Governing Law
- Rewash guarantee: if you are not satisfied with your wash, tell us before leaving or within 24 hours and we will rewash the vehicle free of charge. A rewash, not a cash refund, is our standard remedy for wash-quality issues.
- Refunds for duplicate or erroneous charges go to the original payment method once verified; purchases made on Way.com are refunded through Way.com per its refund process.
- Our facility uses cameras and license plate recognition (LPR) to identify member vehicles, trigger the correct wash, process auto-charges, support security, and investigate claims. By entering the premises, you consent to this recording.
- We collect name, contact, vehicle/plate, payment, and usage information to deliver services and manage plans; marketing communications are sent only with your opt-in consent, and you may opt out at any time. Payment card data is processed by PCI-DSS-compliant providers; we do not store full card numbers.
- These Terms are governed by the laws of the State of Texas, with disputes subject to the courts of Fort Bend County, Texas, except where applicable consumer law provides otherwise.
